Terms and Conditions

1. User Agreement Acceptance

This Agreement governs your access to and use of the DataXing’s Websites and Apps and all services provided through UKPolls, including survey, panel, reward, and related research services (collectively, the "Services").

By registering with UKPolls, accessing the Websites or Apps, or participating in any survey or activity, you agree to be legally bound by this Agreement.

1.2 Changes to These Terms

DataXing may update these Terms from time to time. Where changes are material, reasonable advance notice will be provided through email, account notifications, or through the Website.

Your continued participation in UKPolls or use of the Services after such changes take effect constitutes your acceptance of the updated Terms.

2. Services

The Services allow individuals who meet applicable eligibility requirements to register for the UKPolls user panel (the "Panel") and to participate in surveys, studies, and other market research activities.

Participation in any survey is voluntary and subject to availability, qualification criteria, and compliance with this Agreement. DataXing does not guarantee any minimum number of survey invitations or any level of rewards or compensation.

3. Rewards, Points & Account Status

Once you have joined the Panel, UKPolls may offer incentives in the form of points ("Points") or other reward types for authorised participation, in accordance with applicable UKPolls Rewards Program Terms.

Points are credited only for valid, complete, and compliant participation, as determined solely by DataXing. Points have no cash value unless expressly stated and are non-transferable.

Active Status

Your account is considered Active if you participate in at least one authorised activity within:

• Thirty (30) days of initial registration; or
• Any rolling ninety (90)-day period thereafter.

Dormant Accounts

If you do not participate in any UKPolls activity for a continuous period of twelve (12) months, your account may be classified as Dormant.

Dormant accounts may be suspended or terminated without notice, and any associated Points or Rewards may be forfeited. DataXing has no obligation to notify you before classifying an account as Dormant.

4. Suspension & Cancellation of Account

Your account may be suspended or terminated if:

• You fail to participate within required activity periods;
• You provide false, misleading, or inconsistent information;
• You attempt to manipulate surveys, rewards, or systems;
• You breach this Agreement or applicable law.

If you believe your account was incorrectly suspended or closed, you must contact Support within sixty (60) days of the alleged error, providing full details and supporting evidence. DataXing will review the matter and notify you of its decision within thirty (30) days or as soon as reasonably practicable. All decisions are final.

You may cancel your account at any time via your account settings or by contacting Support. Upon cancellation or termination, your access to the Services will cease and all unredeemed Points will be forfeited.

5. Eligibility Requirements

The Services may be used only by individuals who are at least 16 years of age. The Services are not intended for children under 16. Use of the Services is void where prohibited by law.

By using the Services, you represent and warrant that you meet these eligibility requirements and will comply with this Agreement.

6. Service Fees

There is currently no fee to participate in the Services. DataXing reserves the right to introduce fees for participation or access to certain Services, subject to updating this Agreement.

7. Participation Requirements & Conduct

Your participation is conditional upon full compliance with this Agreement and all applicable policies issued by DataXing.

DataXing may invalidate participation, deny rewards, suspend or terminate accounts, or restrict access if it determines, in its sole discretion, that you have engaged in non-compliance, fraud, or inappropriate activity.

Confidentiality

Survey content may contain confidential or proprietary information. You agree not to disclose, reproduce, or misuse such information.

Registration Information

You must provide accurate, current, and complete registration information and keep it updated at all times.

Multiple Accounts

Only one account per individual is permitted. Multiple accounts may result in immediate termination and forfeiture of Points.

Good-Faith Participation

You agree to participate honestly and not submit false, misleading, statistically improbable, or inconsistent responses.

Survey Integrity

You must not submit multiple responses to the same survey, use automated tools, or otherwise attempt to manipulate survey results.

Communications

All communications with Support or DataXing personnel must be respectful and appropriate.

8. Prize Draws & Promotions

UKPolls may offer prize draws, sweepstakes, or promotional activities from time to time. Each will be governed by its own specific terms and conditions.

Participation is voluntary, eligibility-based, and winning is not guaranteed. DataXing's decisions regarding prizes are final.

9. Referral Links

UKPolls may provide referral links allowing Members to invite others to join the Panel. You must not misrepresent UKPolls, DataXing, or the Services when making referrals.

Any abuse or misuse of referral mechanisms may result in forfeiture of referral rewards and termination of your account.

10. User Content

Any responses, feedback, or content you submit ("User Content") are your responsibility.

By submitting User Content, you grant DataXing a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable licence to use, reproduce, modify, analyse, aggregate, publish, and display such content for research and business purposes without compensation.

User Content represents the views of individual users only and does not represent the views of DataXing or UKPolls.

11. Intellectual Property

All content, software, systems, trademarks, and materials associated with UKPolls are the property of DataXing or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, revocable, non-transferable, non-exclusive licence to access the Services for personal, non-commercial use only.

12. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. DataXing disclaims all warranties, express or implied, including availability, accuracy, fitness for a particular purpose, and uninterrupted operation.

13. Limitation of Liability

To the fullest extent permitted by law, DataXing shall not be liable for any indirect, incidental, consequential, or punitive damages.

Any liability shall not exceed the retail value of the applicable unredeemed reward giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless DataXing from any claims, losses, damages, or expenses arising from your use of the Services, User Content, or breach of this Agreement.

15. Third-Party Content

The Services may include links to third-party websites or content. DataXing does not control, endorse, or assume responsibility for third-party content.

16. Privacy & Data Protection

Personal data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, as described in the UKPolls Privacy Policy.

Your data may be processed or stored outside the UK where appropriate safeguards are in place, including standard contractual clauses or equivalent lawful mechanisms.

You have the right to access, correct, delete, restrict, or object to processing of your personal data, and to withdraw consent where applicable.

17. Essential Communications

Receiving emails and electronic notifications from UKPolls is an essential condition of membership. These communications may include survey invitations, account notices, and service updates.

If you opt out of such communications, DataXing may suspend or terminate your membership.

18. Assignment

DataXing may assign or transfer its rights and obligations under this Agreement to another entity, including in connection with a merger or restructuring. You may not transfer your rights without DataXing's prior written consent.

19. Language

These Terms may be provided in languages other than English for convenience. In the event of any inconsistency, the English-language version shall prevail.

20. General Provisions

• Electronic Communications: You consent to receiving notices electronically.
• Severability: Invalid provisions do not affect the remainder.
• Entire Agreement: This Agreement constitutes the entire agreement between you and DataXing regarding the Services.
• Survival: Clauses intended to survive termination shall remain in effect.

21. Governing Law & Jurisdiction

This Agreement and any dispute arising out of or in connection with it shall be governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction, and all proceedings shall be conducted in the English language.
